The aim of Harrington Brooks' repossession service is to enable homeowners threatened by repossession to retain ownership of their property. This is done by a financial review to maximise money available for mortgage payments and by legal representation to defend or overturn court action taken by a creditor.

Establishing the Facts.

Firstly we need to understand how your currently difficulties arose, and the stage repossession proceedings have reached. Then, we'll take a financial statement from you, detailing your income and outgoings to ascertain if you can realistic afford your current mortgage payments on an ongoing basis. Many people who come to us for help accept they can't afford their mortgage and want to avoid repossession to gain time to sell or refinance. If this is the case for you, avoiding a forced repossession is essential as it could otherwise cost you many thousands of pounds.

Is the mortgage affordable?

Often there is a blameless reason why people have fallen into arrears. Maybe now you're putting these troubles behind you or you are anticipating an upturn in your financiers. Many people we speak to have fallen into mortgage arrears as they are paying lower-priority debts at the expense of their mortgage. This is a classic mistake. Many people tend to pay unsecured debts (ie overdraft, credit cards, etc) ahead of their mortgage because unsecured creditors can more aggressively chase payments for accounts in arrears.

If by reducing your unsecured loan repayments, you could afford your mortgage, and at least make some token arrears repayments, then this is a solution we may suggest. This is normally by means of a debt management programme, or possibly an IVA should your circumstances qualify.

Paying Mortgage Arrears

The law states you should allow to repay your arrears over the remaining period of your mortgage. You do not have to adhere to the demands of your mortgage provider. The judge will attempt to decide on a payment schedule that you can afford and that is also fair to your lender.
