Statutory Paternity Pay
Statutory paternity pay is a weekly payment you get from your employer to help take time off work when your partner has just given birth.
To qualify for statutory paternity pay you must have been:
- Employed by your present employer without a break for at least 26 weeks up to and including the 15th week before the baby is due.
- You must continue to work for that employer without a break up to the date the child is born or placed for adoption.
- You must be earning an average of at least £102 per week (before tax).
If you qualify for SMP, it is paid:
- For two weeks at the lower of either the standard rate of £128.73, or 90 per cent of your average gross weekly earnings.
Statutory paternity Pay is not means tested, but counts as income for other means tested benefits.
It is not taxable.
